Distinguish between an offer and an invitation to treat.
Answer
An offer is a definite promise made by one party (the offeror) to another (the offeree), which is capable of being accepted, thus creating a legal obligation. On the other hand, an invitation to treat is merely an indication that a party is willing to negotiate or is open to receiving offers, but it is not itself capable of being accepted as a binding offer.
