In order to constitute stealing, there must be an element of fraud.

Required:
State THREE fraudulent intents as provided for by the Criminal Code.

  1. Intent to Permanently Deprive the Owner: The intent to permanently deprive the rightful owner of their property is one of the key elements in constituting fraud in cases of stealing.
  2. Intent to Convert for Personal Use: The intent to convert the property for personal use, without the owner’s consent, is also considered fraudulent.
  3. Intent to Transfer Property to Another Person: If the intention is to transfer the ownership or benefit of the property to another person without authorization, it constitutes fraud.
