BCL – L1 – Q13 – Contract Law
Question
Explain the concept of a contractual obligation and the elements required for a valid contract.
Answer
A contractual obligation arises from a legally binding agreement between parties. For a contract to be valid, it must include essential elements: offer, acceptance, consideration, intention to create legal relations, legality of purpose, and capacity of the parties. An offer is a clear proposal, acceptance is an unqualified agreement, consideration involves something of value exchanged, and both parties must have the legal capacity to contract. These elements collectively form the foundation for enforceable contractual obligations.
